All a parent needs to know about UP Private School Ordinance

UP Private school ordinance (exact name is Uttar Pradesh Self Financed Independent schools Ordinance 2018) came into force in month of April this year (2018). Following are the key takeaways from the UP Private school ordinance that a parent shall be aware of:

1. 1. Fees Component: Schools can only charge fees under following heads. Demanding any other component of fees shall be considered illegal:
      

      i	Prospectus and Registration fee
      ii	Admission fees
      iii	Examination fee
      Iv	Composite Annual fee
      v	Transport fees
      vi	Boarding fees
      vii	Mess or dining fees
      viii	Excursions fees
      ix	Fees for Any other similar activity
      x	Refundable Security-caution money

   2. Uniforms and Stationary: Schools can not force parents to buy uniform, stationary and books from a specific shop. Schools can not change school dress in a period of five years.
   3. Fees increase formula: Ordinance has specified a formula for  a school to revise its fee annually. Formula is summarized as below:Fee structure of 2015-16 is to be taken as the base year fees and current year fees to be calculated on the basis of least of the two:-
      • Average percentage per capita increase of monthly salary of teaching staff of previous year.
      • Latest available yearly percentage increase in consumer price index plus five percent. Calculation for this CPI + 5% logic was shared by us at this link.
   4. Mandatory disclosure: Except for 2018-2019 session, schools need to disclose all the below information 2 months before commencement of session (for 2018-2019, schools are expected to disclose within 1 month after commencement of ordinance as act):
      • General information about school, its accreditation and affiliation details.
      • Admission policy.
      • Fee structure of previous year, current year and ensuing year.
      • Details of student to space and student to teacher ratio.
      • Details of facilities.
      • Details of teacher qualification.
      • Details of events carried out during session for the students.
      • Details of events to be carried out during session for the teacher training programs.
