Alert: Stamp duty changes for group housing flats in Noida and Greater Noida

Update: As of 10th August, 2015, further changes to 7th August notification has been made. The 10th August notification has modified the floor wise discount logic further with discount now starting from 4th floor instead of 6th.

Dear Readers, while circle rates for other categories have increased this year, circle rate for group housing category has fortunately not increased (please find circle rates for noida at https://go4reviews.in/2014/11/group-housing-circle-rate-in-different-sectors-of-noida/ and greater noida at https://go4reviews.in/2014/12/circle-rates-for-greater-noida-group-housing-society/).

However, stamp duty on registration for group housing society could see a substantial change.

We see how it could impact the stamp duty calculation

The two main changes are:

1) For Noida, Cap on surcharge on amenities reduced from 25% to 15%. i.e. you only pay maximum of 15% over stamp duty instead of 25% that you were charged previously. That’s a considerable benefit. For Greater Noida, the surcharge cap has been reduced from 12% to 10%.

2) Floor wise relief logic changed. Now floor wise relief to start from 4th floor (updated to 4th floor on 10th August, 2015 from previous 8th August’s notification for 6th floor) and onwards at 2% per each floor. For Noida, this is a loss for floors from 3rd to 12th. For Greater Noida, this will be a slight loss for 1st floor to 9th floor.

Based on the news, we also have the modified stamp duty calculation below for you:

Please note:

  1. There is 10k discount for women only allottee
  2. All other discounts like floor discount are already considered as part of calculations above.

Further to above stamp duty, an allottee has to pay the following at the time of registration:

  1. Registry charges of around 22k
  2. (Not essential) Lawyer charges of around 10k to 25k depending upon whether you are going through self appointed lawyer or builder appointed lawyer (not essential if you are doing the registry yourselves. see steps for registry here).

    Just an update you might have already come across: Sub registrar has confirmed that stamps bought before 31st March will be valid for registry within 4 months till 31st July.

    Hi Guys,

    Appreciate, your efforts for the welfare of buyers, I have a flat in Gaur city 2 16th Avenue, 1010 sqft, 14th floor with one open parking, i have received the fitout letter and paid final payment to builder except registry amount. i heard that from 1st April stamp duty is going to increase, can you please let me know what will be the expected registry amount after increase, builder asked 20k extra in cash for lawyer fees etc. and stampduty they told me 1.75 lac earlier. its been 6 months i have received the fit out letter but i don’t want to block my capital now as i don’t need the flat urgently to live or let out, so please let me know how much i have to pay after stamp duty increase and also let me know any other documentation firm (number and address) who can help me getting my flat registered. applicants are me and my wife both.

    After making the final payment to the Builder, Can I delay the registry of Flat for next 3 months ?
    As per the fit out letter, The Contractor will start the final finishing work after the registration of Flat. Also, It seems like The final possession would take another 3 months.
    So, I don’t want to make the registry of Flat now and Block the Capital.
    N.B. I don’t need the flat now or immediately. I need some time to arrange the money and before registry, I want to Close my Home loan. Pls Advise…

    Hello Sir..
    I have received a fit out letter from Gaursons regarding the final Outstanding payment and receiving a NOC from HDFC Bank for GAUR CITY-2, Avenue-12, Sector- 16C,Greater Noida. Is the fit out letter valid for clearing the final payment or I should ask for possession letter?
    Afterwards, I want to know about registration fee + stamp duty+ extra charge as applicable.
    Flat Details: Gaur city-2, Super area- 1055 sq.ft; 23rd Floor with 1 covered Car parking. I believed the circle rate is 30K but I brought it in 3950 per sq.ft..

      Unfortunately thats the norm, builder asks for final payment at offer of possession i.e. at final fit out phase as opposed to actual possession. You may go ahead with the payment but make sure you communicate in written with the builder that you would pay only if flat is livable, actual possession is offered etc. before actually paying
      Stamp duty in your case would be 1 lakh 98k but it is subject to increase starting 1st April if stamp duty hike is notified by then.

      Stamp duty shall be around 6 lakh, 40 thousand. However, if notification of further 2% increase is indeed raised, this could well cross 7.5 lakhs

    There is news coming up that stamp duty will increase to nearly 7% from April 2016. Will the change be applicable for an in process registry also? And from which point any application is considered in process?

      That is not likely to happen this year due to upcoming elections. It is considered on the day you purchase stamp papers.

    Hello,

    My flat is booked on my brother name. However , brother want to make registry on my name. I am own elder brother of him. Builder not allowing to change the name before registry. What can I do in this case to get registered on my name with less charges? Do we need to declare this at time of registry or gifting at time of registry or after registry is the only option to re-register? Please let me know all the options.

      Yes, builder will not allow name change post they submitting papers to NA for registry. you may need to do this after registry. You can get more info from Samreaddhi documentation.       Circle rate is 40k but since your BSP exceeds circle rate, same would apply. Your stamp duty will be around 3 lakh 88 thousand and another 11k for registration.

    The builder calculation of stamp duty is
    if (Circle Rate + 15% for amenities + 3/1.5 L for parking – 2-20% floor discount) <((is less than) BSP
    then the stamp duty = 5% of the BSP.

    However some of my online research has led me to believe that the calculation should be

    if circle rate < bsp
    then stamp duty = 5% of (BSP + 15% for amenities + 3/1.5 L for parking – 2-20% floor discount)
    else stamp duty = 5% of (Circle Rate + 15% for amenities + 3/1.5 L for parking – 2-20% floor discount)

    Can you guys who have gone through registration of new property help me understand the correct calculation or check with the Noida Sub- Registrar office for the correct calculation for the convenience of rest of the forum members?

      Stamp duty would be around 4 lakh, 25 k considering 10k discount for ‘female only’ registration. Have also assumed that BSP is lesser than circle rates application in sector 137 which is 50k per sqm. Registry charges will be 11k subject to change soon. Other expenses would be lawyer charges that would vary between 10k to 20k.

    Its a very helpful post.
    I’ve a flat on 11th floor in Gaur city with 1500 sq ft area., with one covered car parking. I’ve purchased at 1950/sq ft. jointly with wife. Will stamp duty be calculated at current rate or booking rate. I am expecting possession by Dec 15. R we supposed to do the formalities or builder arranges for it ? I calculated, it comes ~Rs 150000/-

      Hi, Formalities are initiated and done by builder but they charge around 15k to 20k for lawyer fees. A lawyer outside will charge around 8k to 11k.
      You will be charged at circle rate which is 32000 per sqm for sector 4 and hence stamp duty will turn out to be around 2.1 lacs

      Hi, Point wise:

      1) Once lease rent is paid by builder to authorities, it is responsibility of builder to get registry done in 6 months time. Hence, many builders are particular about that.
      2) For registry calculation, please refer the calculator for greater noida. BSP and parking type is also required. Applicable circle rate for sector 1 is 32000

        Hello again,
        The builder is giving me a estimate of Rs. 1,87100. (at 5 %) for stamp duty of my flat, I wanted to know if this is correct.
        Flat details:
        GaurCity 12th Avenue, Sector 16C Greater Noida West.
        Flat Area:1055 sqft.
        Floor:16th
        Total Price:3741000/=
        1 Open car parking.

        One other thing that I wanted to know is that floor discount is applicable in my case or not? The builder says since the price I bought at is more than the circle rate, floor discount is not applicable.

          Stamp duty will be 187039 rounded off to nearest hundred. Yes, this stamp duty calculation is after considering floor discount. Since you bought at more than circle rate, the basis of calculation is your basic sale price but discount is considered in the calculation provided to you.

            Hi Prabhakar, 5% is not simply on BSP. 30k for covered parking, 15% surcharge for amenities is also considered and then 5% is taken over that. You get around 20% discount for your floor (16th). Hence, coincidentally, it comes to that.

    Dear Admin,

    Please let me know the stamp duty calculation for 13th floor at Sector 137.

    The b s p which we have paid for is 5300+100 Rs

    I am not aware of the circle rate.
    Thee calculated amount from above is 688000 but the builder is asking for 750000 for a valuation of 1.5crore of the building value.

          The stamp duty shall be somewhere around 6,72,000 assuming there is 1 covered parking. Circle rate for 137 is 50k per sq m. Add 11k for registry and around 15k for lawyer fees if going through builder.

      You can check with registrar office. Unfortunately we have one for Noida but do not have for Greater noida. But for 5th floor, there is a rebate for sure.

    Also..just wanted to add that I had given the DD (4,41,000/=) to the builder 2 weeks back and they have got the stamp papers for that amount. Now he has asked me to bring additional 24,000/= in cash at the time of registry….

    I have a flat in sec 137 and my registry will happen in a week’s time.
    The flat size is 1835 sq.ft and is on the 7th floor with 1 covered parking. The previous cost of stamp duty was 4,41,000/= and now the builder tells me it has been increased to 4,65,000/=

    I had got the DD prepared for 4,41,000/= but now the builder has asked me to pay the extra amount of 24,000/=

    What’s strange is the fact the builder has asked me to bring the excess amount (24,000/=) in cash at the time of delivery…..He tells me there is no need for the DD..it will elongate the process….

    Can we buy additional stamp papers for cash or is the builder making a fool out of me….

      Hi Chetan, builder’s current calculation is correct and what he had quoted before was wrong. Regarding the cash component, you can check with Samreddhi Documentation as this is a peculiar yet not so uncommon scenario (Please note we are in no way associated with the group but since they deal in registry, they can help you with this).

      There is no change in circle rate for group housing. However, stamp duty calculations have changed due to 10% rebate in amenities surcharge and floor wise discount logic change. There is no loss for anyone. However, for 3rd to 13th floor, the rebate on surcharge is somehow negated by floor wise discount reduction.

    Circle rate for group housing has not been increased and its confirmed. W were working on this issue from last 6 months and met noida DM twice to request not to increase circle rate hike.We have our objections for the same.Also for 25% extra charges ,I raised objections on the same and submitted to Noida DM n requested them to reduce the same.They have accepted our request and today we again met him to say thanks for this help..All this took great effort from us. It also shows nothing is impossible if you work hard for it..

      Noida sector 77, super area 1615 sq ft
      BSP: Rs 3400 per sq ft
      Circle Area: Rs 40000 per sq metre for sector 77
      Covered car parking.
      STAMP DUTY CHARGES TAKEN: Rs 346500/-

      Registration charges Don’t Know

        You have not mentioned floor number but based on stamp duty, i am guessing its 5th? If so, calculations are right and matches with our database. Regsitry charges is flat 20k plus taxes.
