Maintenance charges in different Noida societies

<Please note that his is an old article and has charges applicable in year 2015, some societies have increased maintenance by 20%-30% since> Blown out Maintenance charges is just another hardship meted out to poor buyers at the time of possession. It is essential for buyers to understand the rationale behind builder charging a certain maintenance charge. The charge has to be well supported by amenities and facilities. The same has to be reached at after discussions with the buyers and can not be a unilateral decision.

For the benefit of our readers, we list down the ongoing monthly maintenance charges in some of the RTM and recently delivered projects that can be used as a reference point in discussions with the builder.

3c boulevard (sector 100) – 2 psf to 2.45 psf (Surprisingly varies between phases)
Paras Tierea (sector 137) – 2.2 psf
Mahagun Moderne (sector 78) – 2.25 psf (Under review by builder upon buyer’s objection)
Ajnara Daffodil (sector 137) – 2.5 psf (Under review by builder upon buyer’s objection)
Exotica Fresco (sector 137) – 2 psf
Prateek Wisteria (sector 77) – 2.35 psf (Builder has sent communication to increase this to 2.5 psf from July, 2017)

    Gulshan Vivante- 3.25 Rs per sq ft+ Deduction from meter for common area electricity charges, on standard load.
    Frequent power outage pathetic maintenance, midnight your meter balance will be robbed by DG operation on most of the days.

    I am a resident of Supertech Cape Town, Sector 74. Our current CAM charges are 2.5 + tax. Total comes to 2.875/sqft. They take 1 yr advance CAM charges during possession. They have not reduced the CAM charges as accepted.

      Thanks for bringing this to light. We remember having heard the builder agreed to reduce this to below 2 psf. Has builder given a break up of maintenance charges to you?

    This is a common practise but as residents U must ensure that this amount is retained by the Builder in a separate head in the Acct as ” Maintenance Security” & no expenditure from this to be done w/o the express permission from the General Body of the Society. In fact the amount so collected be put in a Fixed Deposit so that the interest earned can be used for issues other than the Maintenance & this too after prior approval. Otherwise let the fund keep on increasing. Some Societies have more than a Crore in this fund & have carried out major repairs w/o taxing the residents .

    HI, I am flat owner in Civitech Sampriti sector 77, builder asking fro 2 years maintenance in advance @RsRs 2.25. What can I do?

      For why they are asking for Rs 2.25, ask them to provide head by head expenditure.
      For why they are asking for 2 years, you should join hand with other buyers and get the period reduced. Generally, 6 months or a year are a norm (and practical also since otherwise buyers who bought for investment would never pay or delay as much as possible when demanded).

    Hi, thanks for the above info, this is regarding Mahagun Moderne, there builder is charging advance maintainence for 2 years + ifms + n no of other components summing up to a huge amount. Could you please help me if i can debate on something, as it was not mentioned during offer and suddenly it came as blow to us.

      if you form a group and contest, you can have it reversed. for instance, buyers of an ajnara project were able to have the period of advance payment reduced. that being the case, you can have it reduced to 1 year which is the general norm these days.

    As per agreement there is 1 year advance maintenance charge at the time of possession. But now builder asks for two year advance maintenance charge in which second year is 3 rupees per sqft.
    I would like to ask you if builder is not form society and not handover that property to society is it legal to ask to buyer for such charges? If building work is in progress is it ok to give such charges?

      You need to form a group and contest this. 6 months to a year advance maintenance is a norm these days. But, anything more than a year can be contested.
      This is a problem with this unregulated business of under construction property. You have to succumb unless you are strong as a group.

    Eldeco Utopia Sector 93A Maintenance rate is 2.5psft.
    Is there any law which states builder is required to provide warranty for the tenure for which it has taken the advance Maintenance ?

      Thanks for sharing. By warranty do you mean general maintenance or warranty of all fittings and defects? As per UP Aptmt act, builder is bound to provide warranty for 2 years after possession.

      3C is asking for 3 months advance while other builders generally ask for a year advance. Builders can at max ask for 2 years advance, the time till which they necessarily have to provide warranty/maintenance. However, you should approach builder to reduce this to a year quoting other examples such as 3C. Few builders have also reduced the period post discussion with buyers.

    Is it legal if builder ask for maintenance charge for 1 year in advance? Since I got some info that builder can not ask for maintenance charge more than quarterly. Please give some light on this.

      There is no such binding on the builder. However, you can quote the case of 3c where maintenance charges for only a quarter was/is asked.

    Ours is a Gp Housing Coop Society, Kailash Dham Sahakari Awas Samiti Ltd & currently the maintenance is managed the Executive Committee, which is a non profit Org. Thus there should be no Service Tax applicable in our case. Hope I have understood correctly!!!.

    There was a news items about Service Tax being applicable only if the Maintenance Charges are above Rs 5000/- a month. Can this be confirmed please.

      Excellent find Inderjit. However, there is some confusion if this ruling is applicable to RWA alone. I have put a RTI for this today as most of the people are giving service tax even if its beneath 5k. Will reply back in 2-3 weeks hopefully.

      Though I have raised an RTI for this, it is confirmed that above exemption is only applicable to no profit making agencies like RWA. Not applicable to profit making maintenance agencies recruited by builder.

      Yes, it is subject to service tax of 12.36% before notification date and 14% after notification date (notification date would most likely be 31st March, 2015).

    The charges are based on the amenities being provided & this should be a critical factor while arriving at these. Also, most of these charges are when the Societies are managed by Management Firms thus have a profit element by these firms included.
