How to file RTI for your group housing society

RTI filing is a crucial tool in exercising your rights for information related to things that impact you. This holds even more significance in the otherwise unregulated real estate sector.

We bring to you a step by step guide to filing RTI specifically for real estate sector.

Steps to file

Following are the steps:
1) Buy Postal order (PO) from post office of requisite amount. Generally, the fees is 10 rupees.
2) In. PO, mention pay to as ‘<Concerned Authority>’ and Payable at as ‘<City where authority exists>’.
3) Write RTI Application. Many authorities publish their own RTI forms but the format is just a suggestion not a mandate. You can very well write a handwritten application.

For a reference, we share below the Noida authority form details. You may also file RTI for other authorities in same format for a well defined structure.

Fill the RTI form available at
http://www.noidaauthorityonline.com/rti-forms.html (you may have to
expand some boxes before printing the form).

4) Provide the details we need to seek under Point 1 (i) of form:

“Request to provide the following information for the group housing project named xxx in sector xxx <city> built by xxx.:

i) Please share certified copy of …

ii) Please share approved tower layout plan for Tower x…”

It’s better to put information in as much detail as possible. e.g. you may ask for no. of flats and floors in Tower X instead of tower layout plan if it suffices.

Also, in some cases, details in local language may help.

5) Provide other details in the RTI form:

e.g. For Noida authority form,

Point 1:

ii) Specify gist of above required info and documents under type of information required

iii) Specify period for which information is required. E.g. From and To date.

Point 2:
Please share all personal details but do not share mobile number to
have all communications in documented mode.

Point 3:
Tick relevant boxes. e.g. copy of document and other information

Point 5: Add Details of PO

Point 6: Specify- By post (suggested mode as everything is documented)

6) Along with PO, send the filled in form/written application by Registered post (not by courier or any other medium) to the PIO concerned (you may also visit the concerned authority in person but keeping things documented is always suggested).

e.g. For Noida authority, post to below address:

The Public Information Officer/The Asstt. Public Information Officer,
New Okhla Industrial Development Authority (NOIDA),
Adminstrative Block,
Sector-6, Noida – 201301

7) Keep a copy of receipt with you.

Finally, ensure you ask only relevant info from the authority. E.g. Fire, Environment clearance related information shall be sought by Fire, Environment ministry instead of Authority.

Please also note that the RTI can be filed by anyone on your behalf. A person filing need not necessarily have a property in the project concerned.

    hi … Wanted to know about cherry county project. How is the builder and does this project have all required approval? is it safe to invest for residence in this society?

      Builder provides decent quality however maintenance has been questionable. unless you work in greater noida, noida expressway, the location is not suggested. In short run, its not livable. In long run, travelling to Noida centre from here will be an issue once population moves in.

    Excellent stuff go4reviews. Very informative article.
    My query is I need to know whether NA has adopted UP Apartment act 2010 and whether my builder comes under the Same act. If yes, is the builder bound to provide me a Builder buyer agreement which my request to provide is so far refused by the builder .
    You think NA Will provide me answer to this query?

    Thanks a lot for such a fast response. But actually list of such projects was prepared and submitted to NGT by noida authority.
    thats why I think it should be addressed to Noida authority.
    Whats your view?

      Hi Nitin, a sub-list of such projects initially named in the petition was sent by NA. You can try your luck both ways.

    1)Type of Information required. Can you please explain in simple language what shall i exactly write in this column.

    Hello

    Very informative like all your posts but I do have a couple of doubts on this.

    a) Is there any category of information which can be rejected by NA ? For eg if I wish to ask them about the CC status of a builder , the number of flats/towers for which he has applied – can NA deny this ?

    b) What exactly is meant by type of information required ? Is this free form text or it has some set values ?

    c) What all documents can be asked to get confirmation on this clarity ? For eg for asking about whether CC has been applied or not . If applied , why has it still not been released or granted.

      Apologies, we seem to have missed your post.
      a) NA can reject RTI applications pertaining to third parties and builder are considered third party in this context. However, the NA is required to ask third party if they are ok with revealing the information. Secondly, you can attach your ownership proof in builder’s project to put pressure on NA not to treat builder as TP.
      b) It is free text (1 or 2 lines max). Just a gist of project regarding which you want the info.
      c) You can ask for certified copy of any document. You can ask for dates of CC and certified copy of response from NA on CC applied.

        Thanks for this clarification .. So if I am asking NA about the completion certificate status of a builder , that would still be taken as third party inspite of the fact that the process in question is handled at NA end and not builder’s end ?
        Will builder be shared details of who asked for the information ? I am bit apprehensive on this point because then the builder might become vindictive.

          NA anyways shares the information of RTI activist with the builder (the black side of the story). You have to take the builder heads on for seeking your rights.
          Regarding CC, NA will tell you when the application was received by them, when they inspected but details about response or specific issues pointed out will still be forwarded to builder for their permission.

            Info on this portal has been of great use for me. But still I have few queries.
            My requirement is to know that whether my project was falling under 10 KM radius of Okhla Bird Snctuary and was it a part of list of such projects submitted by noida authority to NGT.
            Can I directly ask these questions asuuming that authority wil reply in Yes ir no?
            Or please suggest how shall I frame my question to seek the desired info.

            Thanks Nitin. Regarding NGT, your RTI has to be addressed to environment ministry, central government. They will give you the petition that has specific mention of projects. We shall share the same with you tomorrow hodpefully.
